These Terms of Use govern your access to and use of the Riskitera platform (riskitera.com), a GRC+SOC cybersecurity SaaS service provided by Riskitera. By registering or using the platform, you agree to these Terms in their entirety. If you do not agree, you must not use the service.
1. Purpose of the Service
Riskitera is a cloud-based cybersecurity platform (Software as a Service) that provides tools for risk management (GRC), security operations (SOC), incident management, alerts, regulatory compliance, and AI-assisted response orchestration.
The service is provided to organisations and cybersecurity professionals and is not directed at individual consumers.
2. Registration and User Account
- Age requirement: You must be at least 16 years old to create an account.
- Accurate information: When registering you must provide accurate, current, and complete information. You are responsible for keeping it up to date.
- Credentials: You are solely responsible for the confidentiality of your password and for all activities carried out under your account. Notify us immediately at contact@riskitera.com if you suspect unauthorised access.
- Corporate account: If you register on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Acceptable Use
You agree to use the platform exclusively for legitimate purposes and in compliance with applicable law. The following are expressly prohibited:
- Using the platform for illegal, fraudulent, or rights-infringing activities.
- Attempting to gain unauthorised access to systems, networks, or data through Riskitera.
- Reverse engineering, decompiling, or disassembling the platform software.
- Reselling, sublicensing, or transferring platform access to third parties without express authorisation.
- Introducing viruses, malware, or any malicious code.
- Deliberately overloading the service infrastructure (DoS/DDoS).
- Scraping data from the platform in an automated manner without authorisation.
- Publishing or transmitting defamatory, obscene, or intellectual property-infringing content.
4. Intellectual Property
- Platform: All intellectual property rights in the Riskitera platform (source code, interface, design, brand, logos, documentation) belong exclusively to Riskitera. No licence is granted over such elements beyond the use of the contracted service.
- User data: Data you enter into the platform (incidents, alerts, configurations, reports, etc.) is your property. Riskitera only processes it to provide the service in accordance with the Privacy Policy.
- Feedback: If you send us suggestions or comments about the platform, you grant us a worldwide, irrevocable, royalty-free licence to incorporate them into the service.
5. Service Availability
- Riskitera strives to keep the platform continuously available, but does not guarantee 100% availability.
- The service may be temporarily interrupted for scheduled maintenance, updates, technical failures, or force majeure events.
- We will provide reasonable advance notice of planned maintenance windows through the platform or by email.
- We will not be liable for damages arising from service interruptions beyond our reasonable control.
6. Limitation of Liability
- To the maximum extent permitted by applicable law, Riskitera's total liability for any claim arising from the use of the platform shall be limited to the amount paid by the user during the 12 months preceding the event giving rise to the claim.
- Riskitera shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.
- Riskitera is a security support tool. Final decisions regarding incident response or risk management remain the sole responsibility of the user.
7. Data Protection
The processing of users' personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Use. By accepting these Terms, you also accept the Privacy Policy.
8. Termination and Suspension
- By the user: You may cancel your account at any time from the platform settings or by writing to contact@riskitera.com.
- By Riskitera: We reserve the right to suspend or cancel access to the platform immediately if you breach these Terms, without prejudice to any other legal remedies.
- Effect of cancellation: After cancellation, your data will be retained for the period indicated in the Privacy Policy and then securely deleted. You may request an export of your data before cancelling.
9. Modifications to the Terms
Riskitera may modify these Terms of Use. We will notify you of any material change at least 30 days in advance by email and/or notice on the platform. Continued use of the service after the changes take effect constitutes acceptance of the new Terms.
10. Governing Law and Jurisdiction
These Terms of Use are governed by Spanish law. For the resolution of any dispute that may arise in connection with these Terms, the parties submit to the jurisdiction of the Courts of Madrid, expressly waiving any other jurisdiction that may apply to them.
